I don't know how people get on the no-fly list. I have no idea how effective it is. Having said that, the no-fly list doesn't restrict people from traveling, correct?
 
I was put on the no fly list and remained on it for about two years. Zero probable cause.

A friend in Orange County was put on the damned list by mistake because his name matched someone who possibly(?) belonged there. Hell, Stephen Hayes/The Weekly Standard was put on the damned thing because he/wife took a one-way flight to Turkey to catch a cruise. I'm sure hundreds of more examples are out there to support that this is just another colossal cluster-f*ck.

Are you OK with being required to have a drivers license to drive? That is clearly a violation of freedom of movement.

In regards to this post of yours, the federal government does not have the authority to protect freedom of movement. That is a state issue under the privileges and immunity clause. The Supreme Court has agreed.

I am fine with reasonable limitations of rights including no fly lists, drivers licenses, no screaming fire in a crowded theater, etc... Part of life.

Would you apply the same standard of a priori defense to a fugitive from justice (ostensibly suspected but not convicted of a crime)? How about someone under indictment but not adjudicated? Pansies and sheep the lot of you (could be the strong ale speaking...).

The watch lists are reasonable suspicion or even less and no judicial overview or due process at all. A fugitive from justice, arrest warrant, or an indictment is probable cause as found by a magistrate....there is your due process.

So you're saying...there's a mechanism, the mechanism kicks off a process, and within the process is both the Avenue to justify the government's action or rebut the action.

And similar to a null hypothesis, the process itself assumes innocence as status quo until a threshold (however that is defined) is met by the government. If the government doesn't rise to the threshold of validating its action, which is coercive by nature against the individual, then the status quo presumption of innocence is upheld and no rights are coercively taken from the individual.

Seems like that's what I'm reading.

Actually nukes aren't protected by the Constitution. Neither are tanks, artillery, B-52 bombers, etc.

The Constitution protects the right to own "arms." "Arms" referred to small arm weapons that single persons could use in self defense like axes, swords, rifles, pistols, clubs, shovels, knives, etc. Small arms are and have always been well defined.

Specifically not included was "ordinance." "Ordinance" referred to weaponry that required multiple people to operate like cannons, mortars, howitzers, and battleships. Nukes naturally fall into the ordinance category.

I'll humor your blatant ignorance about the "first phrase." Militia? Referred to the whole of the people EXCLUSIVE of the government. Well regulated? Well trained and absolutely no mention of government regulation. After all the Second was included in the Bill of Rights, you know, the documents that specifically limited the federal government. Do you even know why the Second was written and included in the Bill of Rights?

It's all pretty simple if you steer away from moronic liberal talking points and actually read historical material from the period. Federalist Papers might be a good start for you although I suspect it may be well above your reading level. And you're actually a lawyer? That's now about as believable as you owning 30 guns.

Just as a knife is a diminished form of "arm" LA to NY via train or auto is hardly travel - especially in the context of commerce.
 
Lets see... I am red eyeing to London, ON tonight, then to Seattle Wed. night home Friday evening. The economic impact of not flying == probably $2.5 mln in bookings. Yeah, that seems viable.

I would think due process would start with notification of being placed on the list if due process were to be actually applied.
