I just wish I could hear their conversations when they look at alcohol versus marijuana. It is common knowledge trump is very pro sobriety due to his uncle but this is a bad move. The winds have shifted on this and they don't need this fight with everything else they need to get done.

Hey do you know whether they can actually start enforcing mj laws now in states where the DOJ has been looking the other way for years now? Isn't selective enforcement a defense?

They can. "Selective enforcement" isn't a defense. The DOJ has been exercising prosecutorial discretion to not enforce the law inthose states. That discretion can stop at the whim of the investigators and prosecutors.

Man it it looks like there's a potential for 14th Amendment equal protection issues if one state gets federal law enforcement and another one does not. We're talking wholly different protections of federal law in one state vs. another. I see how it's a slippery slope though and I'm talking out of my ass.

Now if you had selective enforcement on the basis of a prohibited by law factor (race, religion, national origin, sex, etc.), you could conceivably have a statutory civil rights violation....for instance if the only people LEO gave jaywalking tickets to were black people.

Yeah, let's just assume that wont' work though. Do you see anything legally (not politically) to prevent the DOJ from announcing commencement of marijuana enforcement on x date and then following through and prosecuting it?

Trump is an idiot if he supports enforcing the federal law on this subject in states that have voted for legalization of recreational marijuana (he might be an idiot for other reasons, but this one is in neon lighting). This is yet again why I plea for the Democrats to vote sensibly for the DNC chair and the party future. A credible opposition party is needed. Keith Ellison doesn't provide basic common sense let alone somebody to lead the party into 2018 and 2020 with any victories.

Dude, I'm not a conservative. Not even close. Just not a fan of the current Dem party and won't be going back until they act like they've got some common sense. I don't give a shit about pronouns or who uses what bathrooms.
