I've seen several of those stickers on gas pumps when I'm filling up and thought they were funny. Evidently it's illegal to place stickers protesting high gas prices on gas pumps.

But the gas pumps are private property. You wouldn’t want somebody plastering your car with Biden stickers, I think.

But if I was the owner of the gas station, every pump would have those stickers on them!
I don't know if you would win but argue that it is like the flag burning. No property was damaged in this case as well. You should be able to draw a line between a personal car and publicly used gas pump.

A publicly used gas pump is privately owned property and defacing privately owned property should not be considered free speech.

I think there is enough government regulation of the pump to warrant constitutional protections. In this case a decision like the Tinker Test may have some limited application. Did the expression substantially interfere with the operation of the pump? Where does public and private begin or where is the side walk?

You purchase a flag and decide to burn it, you’re golden. You take a flag that’s not yours and burn it, you have committed a crime.

Note that the Oklahoma state law also covers defacement of property (i.e., graffiti, stickers, etc.):

§21-1760. Malicious injury or destruction of property generally - Punishment - Damages.​

Universal Citation: 21 OK Stat § 21-1760 (2014)
A. Every person who maliciously injures, defaces or destroys any real or personal property not his or her own, in cases other than such as are specified in Section 1761 et seq. of this title, is guilty of:

1. A misdemeanor, if the damage, defacement or destruction causes a loss which has an aggregate value of less than One Thousand Dollars ($1,000.00);

2. A felony, if the damage, defacement or destruction causes a loss which has an aggregate value of One Thousand Dollars ($1,000.00) or more; or

3. A felony, if the defendant has two or more prior convictions for an offense under this section, notwithstanding the value of loss caused by the damage, defacement or destruction.

Well I've never heard of the Tinker Test, so I can't comment on that. But in my opinion something is private property when someone buys it, installs it and makes it available to dispense the product. IMO it doesn't matter if it interfers with the operation of the pump. If the owner doesn't want his property to be defaced, then no one should deface it.

Fair enough, but what would be the value of the loss? Also, could you define how a sticker is maliciously placed on the pump? Not sure these key elements are being met.

It does seem to be an awfully low-key crime, hardly worth an arrest. But it’s defacing someone’s private property nevertheless, and the owner of said property deserves justice, even if it’s nothing more than making the perp remove the sticker and banning him from ever coming to that gas station again. I’m with Wyoming on this. If it were my gas station I’d put one of those stickers on every pump I own.

When the employee gets sent out to the same pump to remove another sticker for the 8th time today, 7 days every week, has the finish on the pump become damaged by another scraping with a razor? Hard to say from here.

That's not free speech. It's vandalism. You don't get to molest other people's property. The left does it by stealing, spray painting, or burning it down. The right does it with stickers. One is more wrong than the other. But they are both wrong.

I would disagree with that, I read it as it has to placed with intent to harm.

Don't get me wrong, I'm not trying to be pushy, just like arguing the point. The law can be read a million different ways. Intent, and interpretation become a big part of how it is enforced. I would look down upon any owner filing suit for a sticker, and even a DA that took the case. At the same time, I believe the law is the law, and if you break it don't be surprised when someone calls you on it.

This man obviously had some element of malice to have the audacity to deface private property with political stickers…he completely lost his sh!t when he got called out for doing it lol.
