For some time now we have talked about setting up a family cemetery on my wife's side of the family. Her dad as well as all of her siblings and spouses are all in aggrenance.

Does anyone know where to go to get a permit or see what documentation has to be filed with the state to get this set up?

vetmedpoke,

Generally, so long as the site is outside of the city limits, it is lawful in Oklahoma to create a private/family cemetery. But you must amend your property records to incorporate some sort of restrictions on the use of that portion of the property and to give notice to any future owners.

Probably the best thing to do is to contact your county govt where the land is located and ask them if they have any statues or regulations regarding establishing a cemetery on private land. Secondly, if that portion of the property is within the city limits, or apparently up to 3/4 mile away from city limits, you will need to check with that city's legal dept as well. So even if the State has no restrictions, it is possible that a county or city may have jurisdiction and rules regarding doing so within their authority.
