Looks like Don Jr's wife filed for divorce.

Regardless of how you feel about politics, you have to hate this. They have small children and that's almost never good for them.

True, if what he said and did is considered to be confidential as part of the "communications privilege" element of the "Spousal Privilege." On every other issue that is not covered by that privilege, there's nothing he can do to stop her from testifying if she so chooses, as covered by the "Testimonial Privilege" element as per Trammell v US.

And yet, the assets she realizes from the divorce will be protected. Pretty damn smart play in my book, especially if you want to make sure the kids aren't substantially impacted.

My point was that not ALL communications between spouses are privileged. Only those conversations which occurred between the two of them. If she was privy to conversations Jr had with other people while they were married, then likely no privilege exists. So in reality, there's still likely a lot of things she could testify about (if she chooses to do so) and once the divorce is finalized her testimonial privilege is ended automatically.

And my point was I never said ALL communications between spouses are privileged. What I said is that statements that were privileged as a result of the spousal privilege don’t suddenly lose that nature upon divorce.
