American Bar Association: Delay Kavanaugh until FBI investigates assault allegations

Washington (CNN) — The American Bar Association is calling on the Senate Judiciary Committee to halt the consideration of President Donald Trump's Supreme Court nominee Brett Kavanaugh until an FBI investigation is completed into the sexual assault allegations that have roiled his nomination.

In a strongly worded letter obtained by CNN Thursday, the organization said it is making the extraordinary request "because of the ABA's respect for the rule of law and due process under law," siding with concerns voiced by Senate Democrats since Christine Blasey Ford's decades-old allegations became public.

"The basic principles that underscore the Senate's constitutional duty of advice and consent on federal judicial nominees require nothing less than a careful examination of the accusations and facts by the FBI," said Robert Carlson, president of the organization, in a Thursday night letter addressed to Senate Judiciary Chairman Chuck Grassley and ranking Democrat Dianne Feinstein.

"Each appointment to our nation's Highest Court (as with all others) is simply too important to rush to a vote," Carlson wrote. "Deciding to proceed without conducting additional investigation would not only have a lasting impact on the Senate's reputation, but it will also negatively affect the great trust necessary for the American people to have in the Supreme Court."

The comments are striking because the organization gave Kavanaugh its highest rating of unanimous, "well-qualified" for the Supreme Court. Kavanaugh himself touted that rating at Thursday's emotionally-charged hearing where he denied Ford's sworn testimony that he attempted to rape her when they were teenagers.

In all fairness, the Republicans and Trump administration only take advice from the Russian Bar Association. Think they'll have a letter out soon?

Color me shocked, an organization known for it's liberal advocacy is asking to delay the nomination of a person seen as a conservative to the SCOTUS.

Interesting as I would think an org that is so closely aligned to the law would apply such common law standards as statutes of limitations to these accusations.

Maryland, where the alleged incident occurred, has no limitation of prosecution time for sexual assault/attempted rape.

Also, this hearing isn’t a criminal matter, so limitation of prosecution statutes don’t really apply.

Do we even know if this occurred in Maryland? Are we sure it wasn't across the border in Virginia? How about Penn? Per her own testimony, she can't recall where the assault actually happened.

The ABA is exactly right. Anyone who really cares for our judicial system and respects the rule of law knows a further investigation of this is needed.

So now the ABA wants the Supreme Court stacked with leftist judicial activists? If this is the case, why did they earlier give Kavanaugh their highest rating for the Supreme Court? Why did Kavanaugh and other Republicans cite the ABA before today?

The President of the ABA signed the letter, no indication he was speaking on behalf of all ABA members (how could he, vote taken?), nor did the ABA form a judicial review committee to review this issue and offer an opinion.

The Board of the ABA did not issue the letter.

President of the ABA took it upon himself to basically offer his political and legal opinion. I am sure many of the members of the ABA may not share his opinion.

What I don't do is praise the ABA on Thursday because they gave a nominee a high rating and then attack them as liberal hacks on Friday when they simply call for a further investigation of serious allegations against that nominee.

They are either the gold standard or they aren't.

Or I can make up my own mind and when new facts are in front of me I can incorporate them into that opinion.
 
For me, evidence of a crime committed and criminal conviction. Enough evidence that is presented to a jury to render a guilty verdict.

And again, you have to investigate to obtain such evidence.

This isn’t a court of law. The burden of proof beyond reasonable doubt doesn’t exist here.

It’s purely a choice of a handful of Republicans. No more no less.
