Oddly not mentioned by our Supreme Court reporter @AC2020.

Biden can end Trump’s “remain in Mexico while seeking asylum rule”.

Disclaimer….noting the decision is not the same thing as agreement with the decision. Haven’t really thought this one out much from a Constitutional or public policy perspective. No hairtrigger reactions from me.

With Biden's dismal approval rating on the border crisis, I'm not sure I'd call this a "victory" unless self implosion is the end goal.

Seems obvious that one executive action can be edited/reversed/canceled by the subsequent executives. If you want it to last further than that then get it voted into law or in a Senate ratified treaty.

This. So much this. That’s why I generally like this decision. It takes away power from the Executive branch. I’m not a fan of executive orders in general and would really had to see what would essentially be unilateral legislative authority in the hands of the President.

It’s clearly a victory in the Supreme Court.

What he does with the rope that has been handed him is another question altogether.
I kind of take a longer view of these things. Maybe it is a short term win for Joe. But it's really a long term victory for proper checks and balances on the executive branch. I'm good with that even though I think it is better policy to keep 'asylum seekers' on foreign soil.

Agreed emphatically

Wasn't really even being practiced anyway....read something like only 4,300 people actually fell in this protocol since the idiot became president. There are already laws on the books that address the border yet not being enforced.

I see it as a victory for cho xiden, but a pyrrhic one since the blue areas of the country he's already losing (from 2020), are just going to be lost that much more now because this is an invitation to come on over with the knowledge that you'll be caught (maybe), then assuming your not a criminal will be released and expected to show back up in court. Sure the numbers of those that honor their date to appear are super high right?

JD I'm with you on this. Time for congress to do their dam job and not only decide how this is going to be addressed, but also enforced.

I agreed with you on those a couple of posts up. :)

Seems like the court has been pretty consistent with all these rulings. If you want something to be a LAW, then implement it as a LAW. That's the 'stay in Mexico', Roe v Wade, and WVvEPA rulings all in a nutshell.

I don't always post SC decisions, but when I do, my ADD leads me to post the first thing I see on the Tweeter.

Seems to me this SCOTUS is going to force Congress to do it's job instead of playing political games. That's a good thing IMO.
