I could google these answers, but I know I will have to read through a bunch of minutiae before I find my answers. I figure some of you guys know the answers.

If the Senate is split 50/50 on a vote, I know that the VP casts the tiebreaking vote. Does he vote on any item where the results are split evenly, or only certain items? In other words, are there some items where a majority is required and the item is defeated if at least 51 Senators don't vote for it?

Next question. If something were to happen to Trump during the next 2 years, and Pence were to become POTUS, how is his VP selected? Is another individual automatically raised to that position (AG?), or does Pence pick someone and he is confirmed by House/Senate? Something else?

Thanks in advance for taking the time to answer.

Looked it up. The Congress elects a VP and declares a vacancy in Congress. So, I guess it is possible that Pence could be replaced by a Democrat as VP. I assume that would be followed by a special election (or maybe an appointment) to resolve the vacancy in Congress.

Looks like the VP is also the deciding vote any time the Senate is deadlocked. (which I thought was the case).

The 25th Amendment, ratified in 1967, solved the problem of how to replace a vice president. If the Vice President resigned (or became president), the current president would select a nominee for the vice presidency. Then the nominee would have to be approved by majority votes in both the House and the Senate.

Here's a scenario:

Trump is impeached and removed by the Senate then Pence becomes president.

Pence pardons Trump and appoints him VP.

Pence resigns as president and Trump becomes president.

Trump appoints Pence VP.

Pence would never do that since trump is pro gay marriage.

In that scenario Trump would be very unlikely to get the needed votes in both houses to be confirmed as the new Vice.

Imprimis, I think you need to go back and read Article 1, Section 3, Clause 7 again. If the President, VP, etc. is convicted by the Senate, not only does the punishment extend to removal from office, but: "disqualification to hold and enjoy any Office of Honor, Trust or Profit under the United States;" Thus, your scenario is not permissible under the Constitution.

Also, once removed from office, that person can be subject to criminal charges, for the same or different, acts for which they were impeached. If Trump were impeached and convicted, about the best he could hope for is that Pence goes all "Gerry Ford" and gives him a pardon. But even that would not stop any state charges that could be filed against him.

Nah. I don't think Trump is going anywhere before 2020, and don't want Pence as POTUS. It was just something that occurred to me and made me curious about how the system works.
