They practice a different kind of law in Cotton County Oklahoma.
Without all the boring legal stuff, here is what happened:
1. Guy files a request for X.
2. We agree he is entitled to X, and sign an agreed order granting him X.
3. Judg takes agreed order granting X, writes in the order that guy gets X PLUS Y PLUS Z. Guy is not entitled to Y and Z. Guy’s attorney agrees with us that his client isn’t entitled to Y and Z.
4. We go to Cotton County for the hearing. Judge calls guy’s attorney a moron for not asking for Y and Z and threatens to throw me in jail for disputing his authority to grant Y and Z. Both attorneys agree that the judge is an idiot that doesn’t know what he is talking about, but whatever.
5. I’m filing an appeal of the judge’s order....which neither side wanted...and getting a stay of that order SO...guy doesn’t get what we all agree he is entitled to while I get the judge’s order (giving Guy things he didn’t want and agrees he is not entitled to) overturned...which will take 6 months to a year.
So I lost an uncontested, agreed, Motion for the first time in my 28+ year career. The only consolation is...so did my “opposing counsel”.
