Ultimately, I don’t think the constitution prevents congress from essentially delegating their authority to the executive branch bureaucracy. I don’t like it and I don’t think it aligns well with original intent, but that’s a different argument.
However, I lean towards the idea that since the authority is granted to congress by the constitution, the only authority delegated to bureaucracy is that which is explicitly delegated by congress, thus a principled narrow interpretation of legislation which creates bureaucratic authority. Congress should be required to take responsibility for legislating and thus face the consequences, which is something they are loathe to do these days.
I hope the SC continues to rule in this manner, placing responsibility back on congress (and states) for political decisions and lessening such lightning rod, riot-inducing decisions.
