My apologies for posting another thread on this subject but it seems the assurances made by a couple of posters about abortion up to birth not being a thing were wrong.
I'm no lawyer, but the wording of this possibly suggests that an infant that was born alive in a hospital and an infant born alive after an elective abortion are an equivalent thing in regards to wrongdoing.

There have been and will continue to be plenty of cases where an infant that was deemed non-viable during pregnancy was born alive in a hospital and the parents chose to make the infant a DNR and thus resuscitation was withheld. Sorry, can't get on board with prosecuting physicians for ethical medical practice. I'd be pissed if the government forced neonatal resuscitation of my known non-viable infant on me.

I could also be reading this passage way wrong...

"(2) Any infant born alive after an abortion or within a hospital, clinic, or other facility has the same claim to the protection of the law that would arise for any newborn, or for any person who comes to a hospital, clinic, or other facility for screening and treatment or otherwise becomes a patient within its care."
