Can the DOJ Indict the POTUS?

It’s never been tested, but yes technically they could, there is a DOJ memo that says they shouldn’t but it’s more of a guideline than a rule. I say we should test it out, maybe a state could since Mueller most likely never will.
IMO - In practice no. He can be named an un-indicted co-conspirator which would force the House to at least consider Articles of Impeachment based on the evidence. That would likely only be considered once the Mueller report is finalized.
Every expert I've heard today, including Cohen's attorney has stated that SCOTUS would have to make a ruling.
