This is a state by state issue. Make sure you listen to someone who understands the laws of the state the property resides.

I work far northern California.

And as mentioned above, I agree that local markets operate differently and state laws differ from one another. Most local brokers would answer questions no charge in hopes that they can represent you regardless if you are the landlord or tenant. Just find one that specializes in your particular property type and market.
