Sounds like a giant pile of shit rule.

He deserves and should get a pardon.
 
YES. Terrible how the prosecution scrubbed the forensic guy who said that evidence matched Behenna's version of events.

Seems like withholding exculpatory evidence is fairly common among government prosecutors. Or maybe they were afraid of going against the new Obama administration and their disdain for all things military.

Michael is no longer incarcerated. Received a parole decision releasing him from Leavenworth. Family now seeking the pardon.

I know him and his entire family. Used to work with his father. A fine group of people all around. His mother now works with the Innocence Project after a career as a prosecuting US Attorney.

In my experience, it is incredibly UNCOMMON for government prosecutors to withhold exculpatory evidence.

Based upon my personal discussions with the family and fairly extensive familiarity with this case, I don’t believe Obama had anything to do with the decision. In fact, he was granted parole and released during the Obama administration on the first time he qualified for a parole hearing under the UCMJ.
 
If he was in convoy, seems pretty odd to consider that a non-combat situation.

JD, can they go back after the prosecutor that withheld evidence? They should, but would they?

Prosecutors have NEAR immunity from suit. Military prosecutors even more.

If this had been a DA, there might have been a lawsuit potential. With it being in the context of a military court martial any action that could be taken would belong to the Army itself.

In my opinion, the prosecutor was overzealous and from that point the Army was concerned about not admitting that the trial was potentially unfair. Administrative inertia is real.

Behennas didn’t hear about the expert until after the trial.

Nobody likes to admit publicly they screwed up and will defend decisions wrongly reached.

Wished it wasn’t true.

Fight against it in my agency.

It’s not an excuse, but it does exist.
